1. Who we are
Noctusoft, Inc. (“Noctusoft,” “we,” “us,” or “our”), a Texas S-Corporation, builds and operates software products. This policy covers account text messages sent and received through the Noctusoft SMS number. Our general site policy is at noctusoft.com/privacy-policy.html. 2. What Noctusoft SMS is
When you sign up for a Noctusoft product, we can text you what your account needs: sign-in links, verification codes, and notices about your account, bookings, and service status. Every message starts with Noctusoft or the name of the Noctusoft product it is about. Noctusoft staff also receive service alerts on this number.
These messages are account and transactional notices. They are not marketing blasts, promotional drip campaigns, or advertising.
3. Information we collect
- Your mobile number, to deliver the messages you asked for.
- Message content and timestamps needed to deliver messages and keep a record of them.
- Consent records (how and when you opted in, from which page or product), retained for TCPA and carrier compliance.
We do not collect Social Security numbers, payment card data, or dates of birth by text message.
4. How we use it
- To send the account messages you opted in to.
- To keep a consent and opt-out record as required by law and by U.S. wireless carriers.
- To troubleshoot delivery and prevent abuse.
We do not use your mobile number or message content for advertising, sale to data brokers, or unrelated marketing.
5. SMS disclosures
- Message frequency varies with your account activity. Most people get a few messages a month.
- Message and data rates may apply, depending on your mobile carrier and plan.
- Reply STOP to opt out. You will receive one confirmation and then no further messages from this number.
- Reply HELP for help, or email support@noctusoft.com.
- Consent to SMS is not a condition of buying or using any Noctusoft product.
6. How you opt in
You opt in on the public form at noctusoft.com/sms/noctusoft/, or in the sign-up of the Noctusoft product you use, by entering your mobile number and checking a box that is unchecked by default, agreeing to receive recurring text messages from Noctusoft, Inc. and that product with sign-in links, verification codes, and notices about your account, bookings, and service status. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe. Reply HELP for help. Consent is not a condition of purchase. Entering a phone number without checking that box is not consent to texts.
7. Data sharing
We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes.
We share data only with infrastructure providers needed to deliver the service (for example, our SMS carrier, Twilio), and when required by law. Carriers are not liable for delayed or undelivered messages.
8. Retention and security
We keep message and consent records for as long as needed to run the service and meet legal requirements. After you reply STOP we keep an opt-out record so we do not text you again. Traffic is encrypted in transit (TLS). Access is limited to staff who need it to run the service.
9. Your rights
- Opt out anytime by replying STOP.
- Ask what data we hold, or ask us to delete it, subject to legal retention (including opt-out records).
