1. Who we are
Earl is a two-way SMS service for licensed real estate agents, operated by Noctusoft, Inc. (“Noctusoft,” “we,” “us,” or “our”), a Texas S-Corporation. 2. What Earl SMS is
Each participating agent publishes one Earl number on their yard sign, listing flyer, and business card. Clients text or call that number about a property inquiry, showing, or listing. Earl forwards the conversation to the agent’s personal phone from a private proxy number. The agent replies in the ordinary Messages app. Earl sends that reply back to the client from the published Earl number. The client never sees the proxy number.
These messages are conversational and transactional about a specific real-estate inquiry. They are not marketing blasts, promotional drip campaigns, or mass alerts.
3. Information we collect
- Phone numbers of the client and the agent, used to route the conversation.
- Message content and timestamps needed to deliver, display, and keep a record of the thread.
- Consent records (how and when the client opted in), retained for TCPA and carrier compliance.
We do not collect Social Security numbers, payment card data, or dates of birth through Earl SMS.
4. How we use it
- To deliver two-way SMS between a client and their agent about that client’s inquiry.
- To keep a consent and opt-out record as required by law and by U.S. wireless carriers.
- To troubleshoot delivery and prevent abuse.
We do not use Earl SMS numbers or message content for advertising, sale to data brokers, or unrelated marketing.
5. SMS disclosures
- Message frequency varies with the conversation. A typical inquiry is a handful of messages, not a daily blast.
- Message and data rates may apply, depending on the mobile carrier and plan.
- Reply STOP to opt out. You will receive one confirmation and then no further messages from that Earl program.
- Reply HELP for help, or email privacy@noctusoft.com.
- Consent to SMS is not a condition of buying a home, listing a property, or hiring the agent.
6. How you opt in
You opt in on the public form at noctusoft.com/sms/earl/. You enter your mobile number and check a box that is unchecked by default, agreeing to receive recurring two-way SMS from Noctusoft (Earl) about your real estate inquiry. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe. Reply HELP for help.
7. Data sharing
We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes.
We share data only with infrastructure providers needed to deliver the service (for example, our SMS carrier, Twilio), and when required by law. Carriers are not liable for delayed or undelivered messages.
8. Retention and security
We keep message and consent records for as long as needed to operate Earl and meet legal requirements. After you reply STOP we keep an opt-out record so we do not text you again. Traffic is encrypted in transit (TLS). Access is limited to operators who need it to run the service.
9. Your rights
- Opt out anytime by replying STOP.
- Ask what data we hold, or ask us to delete it, subject to legal retention (including opt-out records).
